These Terms govern your use of the EraserApp iOS app and related cloud features. They are a consumer service agreement, not an enterprise SaaS contract.
The Apple Licensed Application End User License Agreement (Apple’s Standard EULA) applies to the licensed copy of the EraserApp software when we have not provided a custom EULA. These Terms cover EraserApp services: cloud AI, subscriptions as offered, acceptable use, and content.
If these Terms conflict with a mandatory consumer law that applies to you, that law prevails.
1. Acceptance
By downloading or using EraserApp you agree to these Terms and the Privacy Policy. If you do not agree, do not use the app.
2. Eligibility
You must be at least 13 years old to use EraserApp. If the law where you live requires a higher minimum age, you must meet that higher age. If you are under the age of majority where you live, you may use EraserApp only with a parent or guardian’s permission, and they are responsible for your use.
Cloud AI features (including Pro Enhance and AI Edit) are currently available only to users who are at least 18 years old, or the age of legal majority where they live if higher. By using any Cloud AI feature, you represent and warrant that you meet this age requirement. If you do not meet this requirement, you must not use Cloud AI features.
EraserApp is not a Kids Category app and is not directed to children under 13.
3. The EraserApp service
EraserApp lets you edit photos on device and, if you choose, run cloud-powered AI features such as Pro Enhance and AI Edit. Features, models, and availability can change. Some features require a subscription, a network connection, or prior Cloud AI consent.
We do not promise uninterrupted service, a particular model, or a particular quality of result.
4. Your content and your rights
You retain all rights you already have in:
- photos you select;
- prompts and other text you submit;
- on-device edits; and
- cloud outputs we return to you.
We do not claim ownership of that content.
5. License needed to provide the service
You grant EraserApp a limited license to upload, copy, process, transform, temporarily store, and return content only as needed to provide the feature you requested.
Because cloud tasks may create compressed analysis copies (see the Privacy Policy), you also grant a second, equally limited permission to process those copies for product and scene analysis, service improvement, and security, only as that Policy describes, and only for up to 30 days.
We do not take a perpetual, irrevocable, transferable license for advertising, public display, or “any purpose.”
You represent that you have the rights needed to submit the photo and any prompt, and that doing so will not violate law or third-party rights (including copyright, trademark, privacy, and publicity).
6. Cloud AI features
Cloud AI runs only after you start the feature and give Cloud AI consent (or we already have a valid consent record). Consent happens before reserve, payload creation, or upload. Cancel means no upload for that attempt.
Content may be processed by our cloud infrastructure and third-party AI providers. Providers and models can change. We do not guarantee a named model will remain available.
7. AI outputs
As between you and EraserApp, and to the extent permitted by applicable law, EraserApp does not claim ownership of AI outputs returned to you.
You understand that:
- outputs may be inaccurate, incomplete, or unexpected;
- outputs may be similar or identical to results produced for other users;
- we do not warrant that outputs are original or non-infringing;
- you are responsible for how you use or publish results.
8. Acceptable use
You may not use EraserApp to:
- break the law or infringe intellectual-property, privacy, or publicity rights;
- create or request unlawful, exploitative, or deceptive content;
- probe, overload, or disrupt the service;
- bypass entitlements, consent, or fair-use controls;
- upload malware or attempt to extract provider keys or other users’ data.
We may refuse or stop a task that appears to violate this section.
9. Fair use and service limits
Cloud AI is a shared, paid-cost resource. We may limit frequency, concurrency, or abusive patterns so the service stays available. Specific numeric thresholds are not published in these Terms and may change. Limits are not a promise of unlimited use even if a subscription marketing line says a feature is included.
If a request is limited, you can retry later. Limits do not entitle you to a refund except where Apple or applicable law requires one.
10. Subscriptions and free trials
We may offer auto-renewing subscriptions (for example weekly or annual). A free introductory offer may be available for certain plans if Apple shows you as eligible at checkout.
The price is the price Apple displays at checkout. These Terms do not hard-code a dollar amount.
Apple charges your Apple ID. Subscriptions renew until you cancel. Trial conversion, renewal timing, and tax follow Apple’s rules and the text on the purchase sheet.
11. Cancellation and refunds
Cancel or change plans in your Apple ID subscription settings (or the in-app subscription management sheet when offered). Deleting the app does not cancel a subscription.
Refunds are handled by Apple under Apple’s terms and applicable law. We do not process card refunds ourselves.
12. Third-party services
EraserApp relies on third-party services including Apple, Cloudflare, RevenueCat, PostHog, and AI processing providers such as fal.ai. Their terms and privacy practices apply to their processing. We are not those companies. Details of how they process data are described in the Privacy Policy.
13. Changes to features and availability
We may change, suspend, or discontinue features, models, or pricing (through the App Store) for operational, legal, or cost reasons. We are not liable for downtime, a model swap, or a feature we remove, except where mandatory law says otherwise.
14. Suspension and termination
We may suspend cloud features or stop providing the service if you violate these Terms, if we must do so for security or law, or if we discontinue EraserApp. You may stop using the app at any time. On-device photos remain on your device. Cloud copies follow the Privacy Policy.
15. EraserApp intellectual property
The app, name, branding, and our models/configuration (other than your content) are owned by us or our licensors. These Terms do not sell that IP to you. The Apple Standard EULA covers the licensed application software.
16. Disclaimers
ERASERAPP AND THE CLOUD AI FEATURES ARE PROVIDED “AS IS.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE SERVICE, OR THAT RESULTS WILL MEET YOUR EXPECTATIONS.
SOME PLACES DO NOT ALLOW CERTAIN DISCLAIMERS. IN THOSE PLACES, THIS SECTION APPLIES ONLY AS FAR AS THE LAW ALLOWS.
17. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ERASERAPP IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.
18. Applicable law and consumer rights
These Terms are governed by the laws that apply to your use of EraserApp. We do not require you to sue only in a named exclusive court, and we do not require mandatory arbitration.
Nothing in these Terms limits rights you cannot waive under the consumer-protection or other mandatory laws of your country or region. If you are a consumer in Australia, nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. If you are a consumer in Mexico, nothing in these Terms limits rights available to you under Mexican consumer-protection law.
19. Changes to these Terms
We may update these Terms. The Effective Date will change. For material changes, we will make reasonable efforts to notify you (for example, an in-app notice or release notes) where practicable. Continued use after an update means you accept the new Terms, except where the law requires a different process.
20. Apple Standard EULA
If we have not filed a custom license agreement, Apple’s Standard EULA applies to the licensed application. These Terms add service rules. Apple processes App Store billing and subscription management for purchases made through the App Store.
